1. Introduction

These Terms of Use (“Terms”) govern your access to and use of the website and services provided by Hej Nyfiken (“we”, “us”, or “our”) at hejnyfiken.com and hejnyfiken.se (the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of the Service

Hej Nyfiken is a web application that allows parents and guardians to generate AI-created illustrated books on topics of their child’s interest. The books are intended to be read aloud by a parent or guardian to children aged approximately 5–10.

3. Eligibility

The Service is intended for use by adults (18 years or older). By creating an account, you confirm that you are at least 18 years of age. The Service is not designed to be operated directly by children, although children may be present when the Service is used and may view the generated content.

4. Account Registration

To use the Service, you must create an account using either Google OAuth sign-in or an email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us promptly at hejnyfiken@gmail.com if you suspect any unauthorised use of your account.

5. Acceptable Use

You agree to use the Service only for its intended purpose: generating illustrated books on topics suitable for children. You agree not to:

  • Submit topics or requests that are offensive, harmful, illegal, sexually explicit, violent, or otherwise inappropriate for a children’s content service.
  • Attempt to circumvent any content filters or safety measures built into the Service.
  • Use the Service to generate content that infringes on the intellectual property rights of others, including by requesting content based on copyrighted characters, brands, or properties.
  • Use the Service for any commercial purpose, including reselling or distributing generated books for profit, without our prior written consent.
  • Use automated tools, bots, or scripts to access or interact with the Service.
  • Attempt to reverse-engineer, decompile, or otherwise extract the underlying technology of the Service.
  • Interfere with or disrupt the Service or its infrastructure.

We reserve the right to suspend or terminate your account if you violate these Terms.

6. AI-Generated Content

6.1 Nature of Content

All books generated through the Service are created by artificial intelligence. While we strive to produce high-quality, age-appropriate content, AI-generated material may contain inaccuracies, errors, or unexpected output. The content is provided for entertainment and general interest purposes and should not be relied upon as a sole source of factual or educational information.

6.2 No Guarantee of Accuracy

We do not warrant that the generated content is accurate, complete, up to date, or suitable for any particular purpose. Parents and guardians are encouraged to review generated books and use their own judgement when reading them with children.

6.3 Content Moderation

We employ input filters and prompt-level safeguards to prevent the generation of inappropriate content. However, no filtering system is perfect. If you encounter content that you believe is inappropriate, inaccurate, or harmful, please report it to us at hejnyfiken@gmail.com.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, code, branding, and underlying technology, is owned by Hej Nyfiken and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

7.2 Generated Content

Books generated through the Service are created by AI and may not qualify for copyright protection under applicable law. We grant you a personal, non-exclusive, non-transferable licence to use the books generated through your account for private, non-commercial purposes (such as reading them to your children or printing them for personal use).

You may not sell, distribute, publicly display, or commercially exploit generated books without our prior written consent.

We retain the right to use generated content (including topics submitted and books produced) for the purposes of operating, improving, and maintaining the Service, including quality review and service development, as described in our Privacy Policy.

7.3 Third-Party Intellectual Property

The Service is not designed to reproduce copyrighted characters, brands, or other third-party intellectual property. If generated content inadvertently resembles protected material, this does not constitute a grant of rights to that material. We are not responsible for any third-party intellectual property claims arising from your use of generated content.

8. Pricing and Payment

The Service is currently offered free of charge. We reserve the right to introduce paid features or subscription plans in the future. If we do, we will clearly communicate pricing and payment terms before any charges apply, and your continued use of paid features will be subject to additional terms.

9. Availability and Changes

We aim to keep the Service available and functioning, but we do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable for any loss or inconvenience caused by such changes.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or free from errors, viruses, or other harmful components. We do not warrant that the AI-generated content will be accurate, appropriate, or free from defects.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Hej Nyfiken shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to damages for loss of data, loss of profits, or reliance on generated content.

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you have paid us in the twelve months preceding the claim, or 500 SEK, whichever is greater.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud or wilful misconduct.

12. Indemnification

You agree to indemnify and hold harmless Hej Nyfiken from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, available at hejnyfiken.com/privacy. Please review it to understand how we collect, use, and protect your personal data.

14. Termination

You may delete your account at any time by contacting us at hejnyfiken@gmail.com. Upon account deletion, your personal data will be handled as described in our Privacy Policy.

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, or for any other reason at our discretion. We will make reasonable efforts to notify you in advance where possible.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the “Last updated” date. For significant changes, we may also notify you by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of Sweden. Any disputes arising from or in connection with these Terms or the Service shall be resolved by the Swedish courts, with the Stockholm District Court as the court of first instance.

If you are a consumer resident in the EU, you also have the right to submit disputes to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. You may also contact the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) at arn.se for alternative dispute resolution.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hej Nyfiken regarding your use of the Service, superseding any prior agreements or understandings.
